These Terms of Use govern your access to and use of the Run Fast Racing mobile application and related services provided by Run Fast Racing, LLC. By accessing or using our platform, you agree to be bound by these Terms. If you do not agree, you may not use the Services.
1. Eligibility
You must be at least 18 years of age to use the Services. By using the platform, you represent and warrant that you have the legal capacity to enter into this agreement.
2. Nature of Membership
Run Fast Racing offers subscription-based memberships (monthly, annual, and lifetime) that provide experiential and promotional benefits, including exclusive racetrack access, race ticket requests, community participation, and branding opportunities as an "owner." Membership does not constitute equity ownership in Run Fast Racing, LLC, does not provide any ownership interest in any horse, does not provide rights to proceeds from the sale of any horse, does not provide profit-sharing rights, and does not constitute an investment contract or security.
3. Promotional Rewards
Race-performance rewards are discretionary, may vary by purse size and membership base, may involve third-party gaming partners, carry no guarantees, and create no contractual entitlements. Promotional rewards do not constitute equity or investment returns.
4. Third-Party Gambling Partner
Run Fast Racing is not a betting operator, does not process wagers, is not responsible for betting losses, does not control third-party gaming accounts, and does not guarantee winnings.
5. Membership Payments & Renewals
Monthly and annual memberships auto-renew via the applicable app store platform. Lifetime memberships provide access for as long as Run Fast Racing continues operations. All fees are non-refundable except as required by applicable law or platform policy.
6. Event Access & Tickets
Event access is subject to availability. Certain premium races, including but not limited to elite events such as the Kentucky Derby, may require separate payment. Run Fast Racing does not guarantee specific event access and does not control event cancellations.
7. Assumption of Risk & Limitation of Liability
Participants voluntarily assume all risks associated with attending events. Run Fast Racing is not responsible for injuries sustained at events, race outcomes, horse performance, betting losses, or indirect or consequential damages. Total liability is capped at the amounts paid by you during the preceding 12 months.
8. User Submissions
By submitting content to Run Fast Racing, you grant the company a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such content for marketing, promotional, and business purposes.
9. Termination
Run Fast Racing reserves the right to suspend or terminate your account at any time for violations of these Terms, fraud, or platform misuse.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict-of-law principles.
11. Dispute Resolution
Any dispute arising from these Terms shall be resolved through binding arbitration on an individual basis. You waive any right to participate in a class action lawsuit or class-wide arbitration.
12. Modifications
Run Fast Racing may update these Terms at any time. Continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
